These Terms and Conditions of Use (“Terms”) govern access to and use of the website https://www.reveriebrazil.com.br (“Site”), including its blog, online store, and auction platform, operated by Reverie Brasil Comércio Atacadista Ltda ME , a private legal entity, registered under CNPJ number 37.996.806/0001-91, with its registered office at Address: Street Atila Brandão Nº 49, Santa Maria, Carangola - MG. CEP: 36801-158 (hereinafter “Reverie Coffee”, “we”).
By accessing, browsing, registering, purchasing, or participating in auctions on the Site, you (“User”) declare that you have read, understood, and fully agree to the conditions established herein. If you do not agree to these Terms, please do not use the Site.
These Terms should be read in conjunction with Reverie Coffee's Privacy Policy and Cookie Policy, which are integral parts of this document.
1) Eligibility and capacity
1.1. The User declares to be over 18 (eighteen) years of age and to possess full legal capacity to enter into contracts and accept the obligations set forth herein.
1.2. If the User is under 18 years of age, the use of the Site and the performance of any transactions must occur with the assistance and under the responsibility of their legal guardian, who agrees to these Terms on behalf of the minor.
2) Account, Registration and Accuracy of Information
2.1. To make purchases in the online store and/or participate in auctions, the User must create a registration, providing data such as full name, CPF/CNPJ (Brazilian tax ID), email, telephone number, and address.
2.2. The User agrees to provide true, accurate, complete, and up-to-date information, being solely responsible for any inconsistency or falsehood that prevents delivery, invoicing, support contact, or valid participation in the auction.
2.3. The User is exclusively responsible for maintaining the confidentiality of their access credentials (login and password). All activities carried out on their account will be considered their responsibility.
2.4. Reverie Coffee reserves the right to request additional identity validations (Know Your Customer - KYC procedure), especially for eligibility in high-value auctions, in order to guarantee the security of the platform.
2.5. Providing false information or misusing third-party data constitutes a violation of these Terms and may lead to the immediate suspension or cancellation of the account, without prejudice to any applicable civil and criminal liability.
3) General Rules for Using the Site
3.1. The User agrees not to use the Site to:
a) Violate any applicable laws and regulations;
b) Interfere with the security of the Site, attempt to access restricted areas, circumvent authentication or anti-fraud mechanisms;
c) Reverse engineer, copy source code, scrape data, or improperly exploit the content of the Site;
d) Send spam, illegal, offensive, defamatory content, or content that violates the rights of third parties through forms and comment areas.
3.2. Reverie Coffee may restrict or suspend access to Users who show evidence of fraud, misuse, attacks, attempted intrusions, or any other violation of these Terms.
4) Intellectual Property
4.1. All content on the Site, including but not limited to text, trademarks, logos, photographs, design, layout, videos, audio, source code, and blog materials, is the exclusive property of Reverie Coffee and/or its licensors and is protected by intellectual property laws.
4.2. It is strictly prohibited to copy, reproduce, distribute, modify, or commercially exploit any content from the Site without the prior written authorization of Reverie Coffee, except for personal and non-commercial uses permitted by law.
4.3. Copyright Infringement Notice: If you believe that any content on the Site infringes your copyright, please contact us at contact@reveriebrazil.com.br providing a detailed description of the allegedly infringed work and its location on the Site.
5) Content and Product Information
5.1. The content of this blog is for informational and educational purposes only. It does not constitute technical, legal, or financial advice.
5.2. Product descriptions (e.g., sensory notes, scores, origin, certifications) represent the information available at the time of publication and may vary depending on the batch, harvest, and preparation method. Images are for illustrative purposes only and may vary in color.
6) Legal Guarantee
6.1. Reverie Coffee respects all consumer rights and ensures the legal guarantee against defects in quality or quantity that render the products unsuitable or inadequate for their intended use or diminish their value.
6.2. The deadline for claiming apparent or easily detectable defects is 30 (thirty) days for non-durable products, starting from the delivery date. For hidden defects, the deadline begins when the defect becomes evident.
6.3. Upon discovering the defect, the consumer may demand, at their choice: the replacement of the product with another of the same kind, the immediate refund of the amount paid, or a proportional price reduction, according to Article 18 of the Consumer Protection Code. The procedure for requesting the guarantee is detailed in Clause 11 (Exchange, Return and Withdrawal Policy).
7) Online Store
7.1. Prices, payment terms, and stock availability are subject to change at any time without prior notice, always respecting orders already confirmed.
7.2. Adding a product to the shopping cart does not guarantee its reservation. The purchase is only completed and the stock reserved after payment confirmation by the financial institution.
8) Payment
8.1. Payments are processed through a secure payment gateway. Accepted payment methods are: Wix Payment, Credit Card, Pix, Debit.
8.2. Reverie Coffee reserves the right to cancel orders if there is suspicion of fraud, significant registration inconsistency, or inability to validate payment.
8.3. In case of chargeback or refund, the timeframe for returning the amount may vary depending on the payment method used and the rules of the gateway and the card issuer. Reverie Coffee undertakes to initiate the refund process within 30 business days after confirmation of cancellation or receipt of the returned product.
9) Delivery and Transfer of Risk
9.1. Delivery times indicated on the Site are estimates and may vary due to external factors (carrier logistics, weather conditions, holidays, etc.).
9.2. The User is responsible for providing the correct and complete delivery address. Reshipping costs resulting from an incorrect or incomplete address, absence of recipient, or refusal to receive may be passed on to the customer.
9.3. Reverie Coffee's responsibility for the product and the risks of loss or damage cease upon actual delivery to the customer or a third party authorized by them at the destination address. In case of proven loss or damage during transport, Reverie Coffee will be responsible for arranging reshipment or reimbursement, as agreed with the customer.
10) Auctions
10.1. General Rules: This section defines the general rules applicable to Reverie Coffee auctions. Specific operational details for each event, such as dates, lots, bidding rules, and deadlines, will be published in an attached document on each auction page (“Edition Rules”), which becomes an integral and inseparable part of these Terms.
10.2. Registration and Eligibility: Participation in the auction is conditional upon prior registration and approval of the User's profile by Reverie Coffee, which may refuse, suspend, or cancel eligibility if there are indications of fraud, registration inconsistencies, or risk to the integrity of the auction.
10.3. Bidding Operation: a) Each lot will have a minimum starting bid published on its page.
b) The “Edition Rules” for each auction will mandatorily define:
* The official time that governs the start and end of the auction.
* The minimum increment between bids.
* The existence (or not) of an anti-sniping rule, which extends the auction's end time if a bid is placed in the last few minutes.
* The tie-breaking criterion in case of bids of the same value (the bid registered first by the system prevails).
* The existence (or not) of an immediate bid value (“Buy Now”).
10.4. Obligations of the Bidder: a) By winning a lot, the bidder agrees to fulfill all payment, invoicing, and delivery conditions stipulated in the “Edition Rules”.
b) The “Edition Rules” will obligatorily define:
* The maximum payment deadline for the auctioned lot.
* The penalties for default, which may include, but are not limited to: fines, cancellation of the auction, and suspension of participation in future auctions.
10.5. Integrity and Auditing: Reverie Coffee will use security and auditing mechanisms to ensure the integrity of the process. Bids made by bots, in collusion, or that exploit obvious technical flaws in the system will be invalidated, and the participants involved may be disqualified.
10.6. Inapplicability of the Right of Withdrawal: According to the majority understanding and the nature of the transaction, the right of withdrawal provided for in Article 49 of the Consumer Protection Code does not apply to purchases made in auction mode.
11) Exchange, Return and Cancellation Policy
11.1. Right of Withdrawal (Online Store Purchases): a) For purchases made in the online store (excluding auctions), the consumer has a period of 7 (seven) consecutive days, counting from the date of receipt of the product, to withdraw from the purchase.
b) To exercise the right of withdrawal, the User must contact Reverie Coffee via email contact@reveriebrazil.com.br.
c) The product must be returned in its original packaging, without signs of use, without violation of the manufacturer's original seal, accompanied by the invoice.
d) In cases of withdrawal, the return shipping costs will be borne by Reverie Coffee. The refund of the total purchase amount (product + original shipping) will be made after receipt and verification of the integrity of the returned product.
11.2. Product Exchange Due to Defect or Flaw: a) If the product presents any defect or flaw, the User must contact us within 30 (thirty) days of receipt, as per Clause 6 (Legal Guarantee).
b) The User must send a description of the problem and, if possible, photos or videos to the email contact@reveriebrazil.com.br.
c) Once the defect is verified, Reverie Coffee will bear all shipping costs (return and reshipment) and will proceed with the replacement of the product, the refund of the amount or the price reduction, at the customer's discretion.
12) Privacy and cookies
12.1. The processing of personal data collected through the Site is governed by our Privacy Policy.
12.2. The use of cookies and similar technologies is governed by our Cookie Policy.
13) Site availability and technical limitations
13.1. We strive to keep the Site available and secure, but we do not guarantee its uninterrupted and error-free operation. Downtime may occur for maintenance or due to force majeure.
13.2. In the event of a technical system failure during an auction that demonstrably prejudices the bidding, Reverie Coffee reserves the right, at its sole discretion, to cancel bids on the affected lot and restart the bidding on a new date, notifying the participants involved.
14) Limitation of liability
14.1. To the maximum extent permitted by law, and subject to the mandatory legal warranty (Clause 6) and other obligations set forth in these Terms, Reverie Coffee's liability is limited to direct damages demonstrably caused by its fault.
14.2. We are not responsible for subjective sensory expectations of the consumer (taste, aroma), which may vary depending on the preparation method, or for improper use of the product after delivery.
15) Force Majeure
15.1. Reverie Coffee will not be held liable for failures or delays in the performance of its obligations when resulting from force majeure events or acts of God, including, but not limited to, natural disasters, strikes, wars, pandemics, widespread power or communication failures, and governmental acts.
16) Changes to These Terms
16.1. Reverie Coffee may update these Terms at any time. The current version will always be available on the Site, with the date of the last update. Significant changes that restrict rights or impose new obligations will be communicated with reasonable advance notice via a notice on the Site or by email.
17) Applicable law and jurisdiction
17.1. These Terms are governed by the laws of the Federative Republic of Brazil.
17.2. To resolve any disputes arising from these Terms, the court of the consumer's domicile shall have exclusive jurisdiction when the dispute falls within a consumer relationship. For all other disputes, the court of the District of Street Atila Brandão Nº 49, Santa Maria, Carangola - MG. CEP: 36801-158 shall have exclusive jurisdiction, with express waiver of any other jurisdiction, however privileged it may be.
